~ Virginia Graeme Baker Act ~
You may have heard of the “ Virginia Graeme Baker Pool and Spa Safety Act.” The
VGBA is a United States law named after the daughter of Nancy and James Baker
and the granddaughter of former Secretary of State James Baker III.
Graeme Baker died in a tragic incident in June 2002 when the suction from a spa drain
entrapped her under the water. This Act was first introduced by Rep. Debbie
Wasserman Schultz (FL) and was supported by the Baker family and Safe Kids
Worldwide.
Effective December 19, 2008 the federal law mandates that all public pools and spas
must have certain entrapment-prevention measures in place. Keep in mind, this has
nothing to do with your personal pool as of yet. This safety act is being put in place for
the commercial and public pools.
The Act is a national law that has three major components:
1) The Act prohibits the manufacture, sale or distribution of suction
outlets and covers that are not ASME/ANSI A112.19.8-2007
certified.
2) The Act requires public pools and spas to be fitted with
certain equipment that is intended to prevent death or injury
caused by entrapment, evisceration, or entanglement.
3) The Act allows States that have laws with similar
requirements for public and residential pools and spas to apply
for grants.
~VGBA UPDATES ~
On March 3rd, 2010 the question of how the VGBA will affect residential pool
requirements is finalized.
The Consumer Product Safety Commission ( CPSC) has finalized three aspects that
were still up in the air; Model language for potential state laws; the definition of an
unblockable drain; and the definition of a commercial pool. The law is not a mandate
for all pools. Instead, it provides grants to states that enact pool and spa safety
legislation that meets certain requirements set out by CPSC.
All new pools and spas must have some kind of entrapment protection, whether it be
multiple drains, unblockable drains, or no drains at all. In addition, all drains will need to
have VGB-approved covers.

In 2008 the Florida Legislature passed HB 7135, a comprehensive energy bill that
included new requirements for swimming pools and spas. These requirements, slated
to take effect July 1, 2011, were similar to the energy efficiency requirements passed
in California.
As a professional pool service, we feel it's our responsibility to educate all swimming
pool owners about the new laws coming into effect so that they will be able to make
the right decisions.
On July 1st, 2011 - this new law will affect everyone in the State of Florida with a
swimming pool.
On July 1st, 2011 - Manufacturers sending products into Florida must comply with the
new legislative regulations.
On December 31st, 2011 - Contractors can only install products that comply with the
new regulations.
